From the ATF's Firearms FAQ (N2) May machineguns be transferred from one registered owner to another? Yes. If the machinegun was lawfully registered and possessed before May 19, 1986, it may be transferred pursuant to an approved ATF Form 4. [18 U. S. C. 922( o)( 2)] So the answer really is - you can purchase a machine gun that was registered before May 19, 1986. To further confuse, whats really controlled is the unique part of the firing mechanism that allows the gun to fire automatically - the owner of the above M-4 simply purchased the legal, registered part from a dealer and installed it. This is why prices on automatic weapons (not to be confused with assault weapons) continue to skyrocket - they are not affected in any meaningful way by the expiration of the AWB, and it is still illegal to sell new automatic weapons to private citizens in the United States. So if Gerald can find an MP-5 that was registered before May 19, 1986 - he can buy it. And a big-ass clip :-D - Mike - 10-19-2004 not sure the mp5 was even around pre-86 |
