From our conversation today with them, they expressed that is extremely rare for the manufacturer not to settle as they would rather not pay their own attorneys to fight it out in court. Uhh, i'd look up on that if I were you. Just from some quick Googling you are very much on the hook if this goes past arbitration and to court and then lose. Hopefully it doesn't of course, but it's certainly not a, "we don't pay ever" situation for sure. Re: Lemon Law - JPolen01 - 09-20-2016 Yeah I should have clarified. What Ken said is correct. From the research I have done it seems like an extremely low percentage of these claims even make it to court. I will review the documents once receive them via mail in a couple days. Re: Lemon Law - JPolen01 - 09-22-2016 Received the package from the attorney today. In bold letters on the first page "There is absolutely no cost to you for our legal representation. In consideration you agree to participate as the case progresses." Later in the document: How can (insert firm) provide free legal services? "(Firm) has prided itself in offering legal representation with no cost or fees to the plaintiff. When we win, we seek our fees either by agreement with the manufacturer or through the Court, under State Lemon Law and/or State and Federal Breach of Warranty Laws. These fees are separate from any settlement or award got receive. If we lose we receive nothing. For this reason we must be very selective when we accept cases." They said the process can take anywhere from 2 weeks to 6 months depending on the manufacturer. Ultimately we are hoping for a settlement instead of going to court which seems to be how the majority of these cases are handled once a lawyer is involved. Re: Lemon Law - JPolen01 - 10-13-2016 Update time. Yay! Got a low ball offer from Mazda that the lawyer laughed off. Countered high to hopefully meet in the middle and they came back pretty much where we need to be. With the offer we can sell the car and almost break even which is a win for us. Pretty much getting back what we have paid plus depreciation. Should receive the check within 30-45 days. Moral of the story - don't listen to the clowns on this board. The styling makes it look like an elderly person's car though. Not really sure what to look at. Wife wants to look at 4 runners which I'm not opposed to. (but the Porsche dealer who had it sucked) But for real the 4 runner is like twice the size of the Mazda. Does she really want to deal with that? Also because I'm sure it'll make Taylor cry.
